12 Finders is an equipment brokerage based in the United States. We hold mandates from equipment owners to market and sell their machines. These terms cover your use of this website and your work as a finder.
By applying, listing an item, or referring a buyer, you agree to these terms.
Finders are independent contractors. Nothing here creates an employment, partnership, joint venture, or agency relationship. You set your own hours, choose your own marketplaces, and use your own accounts.
You are responsible for your own taxes. If we pay you $600 or more in a calendar year, we will issue a Form 1099-NEC, and we will ask you for a completed Form W-9 before your first payment.
When you claim an item from our catalogue, it is assigned to you exclusively for 30 days. You may extend a claim by asking us before it expires. Claims that lapse return to the catalogue and may be claimed by another finder.
The item remains the property of the seller we represent. You never take title, custody, or possession of it.
You may list claimed items on eBay (Classified Ad format), Facebook Marketplace, Craigslist, OfferUp, and in local groups or forums. Use only the photos, descriptions, and prices we supply, or your own accurate wording based on them.
You must not: change the asking price without our written approval, claim to own the item, promise delivery dates or financing, collect money from a buyer, run paid advertising in our name, or use our name or marks outside of an active listing.
You are responsible for following each marketplace's own rules. If a marketplace suspends your account, we cannot restore it.
Your commission is 12.5% of the final sale price actually received by us, excluding taxes, freight, and any third-party fees.
A commission is earned when a buyer you introduced completes the purchase and the funds clear. We treat a buyer as yours if they first contacted us through your listing or your named referral within the preceding 60 days. Where two finders introduce the same buyer, the earlier documented introduction is paid.
We pay by bank transfer within 7 days of the buyer's funds clearing. If a sale is refunded, charged back, or unwound, any commission already paid on it is repayable to us or offset against your next payment.
Joining is free. Listing on the marketplaces above is free, and we cover the eBay Classified Ad listing fee. We will never ask you for money, a deposit, or a payment to release a commission. Any expense you choose to incur beyond this is your own.
We invoice the buyer, collect payment, and arrange freight. You do not handle the item, the money, or the carrier. Buyer disputes, warranty questions, and returns are handled by us.
Equipment is sold as described by the seller. We make no warranty of merchantability or fitness for a particular purpose, and you must not make one on our behalf.
Either side may stop at any time, with no notice and no penalty. If you stop, you must remove active listings for our items within 5 days. Commissions already earned on cleared sales remain payable.
We may end a claim or the arrangement immediately if a listing is inaccurate, misleading, or breaks a marketplace's rules.
To the extent permitted by law, our total liability to you for any claim connected with these terms is limited to the commissions payable to you in the 3 months before the claim arose. Neither side is liable for indirect or consequential loss, including lost profits.
We may update these terms. Material changes apply to claims made after the change is posted. These terms are governed by the laws of the State of Illinois, and the state and federal courts serving Sangamon County, Illinois have exclusive jurisdiction.
